Child custody lawyer boca raton - Divorce anywhere in the United States is a complicated process. It is often made even more complicated by the presence of an underage child, whose custody has to be decided legally. To decide which parent gets custody of the child, a general, logical process is followed. What sometimes happens is that social workers certified by the state help decided which parent should have custody of the child. Because the purpose of child custody evaluations is to decide what is in the best interest of the child, the social worker's task involved evaluating a number factors. Some of these factors are the
types of emotional types between child(ren) and each parent
ability and willingness of each parent to provide appropriate and adequate care and attention to child(ren)
location between each parent's residence
history of family
ability of each parent to meet child's/children's material, emotional, etc. needs
The evaluation process involves someone requesting a child custody evaluation, whether that someone is a court, a parent, or an attorney for a parent. The court may very likely appoint a social worker to evaluate the case. From the very outset, steps are taken to ensure that the case evaluator is as impartial and as objective as possible. If the social worker has had a past therapeutic relationship with a child, for example, then that social worker cannot evaluate that child's case.
After such preparations are made to select a case evaluator, the actual evaluation begins. The evaluation must at least include interviews with both parents, the child(ren), as well as a group interview with both parents and the child(ren) all present at the same time. Additionally, the case evaluator has to examine the relationship between the child(ren) and each parent. Usually, case workers also take additional steps to come to a more informed decision. They may examine a child's school and medical records, child care records, as well as records from other institutions. Moreover, case workers will generally interview other people as well, such as friends and extended family members. To ensure transparency in the entire process, before making a recommendation, the case worker also needs a detailed log of all contact, communication, and activity. After a long evaluation and research process, the social workers than make a recommendation as to which parent should have custody of the child.
